Termination as a Breach of Employment Contract
Employment in Missouri is “at will,” meaning that employers in Missouri have the right to fire employees at any time for any lawful reason. However, when an employer unlawfully terminates an employee with a breach of employment contract or on the basis of discrimination, it is known as wrongful termination. An employer cannot fire an employee on the basis of the following:
- Race
- Ancestry or national origin
- Gender
- Religion
- Age (for those who are at least 40 years old)
- Disability
- Having HIV/AIDS
- Military status
It is also unlawful to fire someone in retaliation for filing complaints about harassment or discrimination and to fire someone in violation with a lawful employment contract.
